The Work Permit UK visa allows
an employer to transfer a key or valuable staff member to the UK
from an overseas branch of their organization. A UK Work Permit
enables a non-EU citizen to work in the UK in a specific role for a
specific company. The Work Permit for the UK must be applied for by
the sponsoring company.
Duration
A UK Work Permit visa can be valid for between one day and five
years depending on the length of time requested by the sponsoring
company. The duration of the UK Work Permit sponsorship is also at
discretion of the Home Office.
Eligibility Criteria
Position
The position for which the British Work Permit is sought must meet
NVQ level 3 and above. If the Work Permit visa candidate works in a
profession, they may be required to be registered with the governing
body of that profession. For example a doctor must be GMC
registered.
Education
- A degree; or
- An HND level qualification which is relevant to the post on
offer, or
- An HND level qualification which is not relevant to the post
on offer plus one year of relevant full time work experience at
NVQ level 3 and above, or
- Any degree and three years of relevant experience at a
supervisory level.
Additional Information
UK Entry Clearance
UK Entry Clearance is issued to applicants wishing to stay in the
UK for six months or more. UK Entry Clearance takes the form of a
vignette or sticker placed in a passport at a visa issuing post
overseas (normally a UK embassy or consulate). The applicant must
have already been granted further leave to remain in the UK.
Further Leave to Remain
For those applicants in the UK from 1 April 2004, a UK Work Permit
in itself is no longer valid as an individual's application for
further leave to remain. The onus is placed on the UK Work Permit
holder to complete the FLR (IED) form in order to apply for further
leave to remain in the UK.
It is important that you remember that the FLR (IED) form must be
completed by the UK Work Permit holder and not the company
sponsoring the UK Work Permit application.
Shortage Occupations
Employers who are seeking a UK Work Permit for a person to fill a
position on the UK shortage list do not have to advertise to fill
their vacancy. This is because the occupation has been deemed to be
too difficult to fill from within the resident EU work force. For
all non-shortage list occupations, the company seeking UK Work
Permit sponsorship must prove they have made an attempt to recruit
from within the resident EU work force. This is usually done by
advertising the position for at least 28 days in a national
broadsheet newspaper, relevant trade journal or relevant website.
Spouse/Unmarried Partner
A spouse/unmarried partner of a UK Work Permit holder will be
eligible to apply for entry clearance for a UK Work Permit
Dependency visa providing they can prove they are married or have
been cohabitation with the holder of the UK Work Permit. For an
unmarried partner they must be able to prove that the relationship
has been in existence for at least two years prior to making the
application for the UK Work Permit.

Can I switch my current visa to a work permit while I am in the UK?
- Only overseas nationals in the following categories are
allowed to switch to a work permit from within the UK:
- students who have successfully graduated on a degree course
may switch to a work permit from within the UK;
- postgraduate doctors or dentists or trainee general
practitioners may switch to a work permit from within the UK;
- Working Holiday Visa holders who are switching to shortage
occupations may switch to a work permit from within the UK.
How long does the work permit application process take?
Work permits can be issued in a matter of days. The time taken to
process a work permit can vary depending on the work permit
candidate, the employer of the work permit candidate and the
employment details.
What is the pay and working hours?
Contracts vary from property to property but generally remuneration
is $15,00 ph (including gratuity). Your average working week will be
around 35 - 45 hours depending on the property; however any
additional hours over 40 Hours will be compensated at the applicable
overtime rates or day off.
What are the different kinds of work permit?
- The Business and Commercial Work Permit is a work permit that
enables UK-based employers to recruit people from outside the
European Economic Area (EEA) to fill a vacancy that may
otherwise be filled by a 'resident worker'
- The Training and Work Experience Scheme (TWES) work permit
allows people from outside the EEA to undertake a period of work
experience, or work-based training for a professional or
specialist qualification.
- The Sports and Entertainments work permit enables UK-based
employers to employ established sportspeople, entertainers,
cultural artists and some technical/support people from outside
the EEA.
- The Student Internship work permit arrangements enable
students from outside the EEA studying first or higher degree
courses overseas to undertake an internship with an employer in
the UK.
When can I get a work permit extension?
A work permit extension application must be submitted before your
current work permit expires. An application for a work permit
extension can only be lodged within, 3 months of the current work
permit expiring.
What happens if I can't switch to a work permit from my current
visa while staying in the UK?
You must be outside of the UK on the day when your work permit
application is lodged. Vira International Limited will lodge the
work permit application on behalf of the employer once you have left
the UK and as soon as the work permit application is ready. Once
Vira International Limited submits the work permit application it
usually takes between five and 10 days for the work permit
application to be approved. Once the work permit visa application is
approved, Vira International Limited will send you the approved work
permit. You must then return to your home country and submit an
entry clearance application at the British Embassy in your home
country. Once entry clearance has been granted you can return to the
UK and resume or start working under your work permit. Vira
International Limited will compile the entry clearance application
as part of the UK work permit visa application. .
What happens when the work
permit expires?
If you are in the UK on a work permit and you would like to remain
in the UK after your work permit visa expires you can apply for a
work permit extension. If you have completed 60 months on a work
permit you may be eligible to apply for Indefinite Leave to Remain
(also known as permanent residence). .
What happens to my work permit if my current employment
terminates?
If your current employment terminates you can:
- Find another employer willing to sponsor your work permit.
Please note the new role for which the work permit is to be
issued must be similar to that undertaken in the current
position for which the work permit was issued. An application
for a change of employment work permit must be lodged within 28
days of leaving your current employer.

If I am on a work permit and I leave my job, do I have to
leave the UK?
If you leave your job you have 28 days to find a similar position
with a new employer. During these 28 days, your employer must file a
new work permit application on your behalf. If you do not find a new
employer you must leave the UK within 28 days or you will be deemed
to be in the UK illegally. Although the work permit stamp in your
passport may be valid for a number of years, it is only valid while
you are employed with the company that obtained your work permit.
Can I change employer if I am in the UK on a work permit?
Yes, if you are in the UK on a work permit you can change employer,
however this is only allowed once your new employer has arranged a
new work permit (this will usually take about five to 10 days from
the day Vira International Limited submits the work permit
application).
What is the difference between a work permit and a working
holiday visa?
Yes, if you are in the UK on a work permit you can change employer,
however this is only allowed once your new employer has arranged a
new work permit (this will usually take about five to 10 days from
the day Vira International Limited submits the work permit
application).
What happens if a company gets a work permit to employ me for
two years and then does not employ me for the full period of the
work permit ?
A work permit is not a contract of employment. A work permit gives
the employer permission to employ you, however there is no
obligation for them to employ you. If you are made redundant you are
only entitled to notice/compensation insofar as that which may be
detailed in your contract of employment.
As a work permit holder, can my spouse work in the UK?
The spouse, unmarried partner and children of a work permit holder
may be admitted to the UK as the dependants of a work permit holder.
The spouse/unmarried partner of the work permit holder will be given
conditions of stay, which do not place any restrictions, other than
those that normally apply to a resident worker, on their taking
employment or engaging in business. Therefore, a dependant of a work
permit holder is free to work in the UK as long as the endorsement
in their passport places no restriction on their employment in the

Can an overseas national on a work permit do supplementary work?
Supplementary employment arrangements apply to overseas nationals
who already have a work permit, and who want to take on additional
work to that which their work permit visa was issued for. Under
these circumstances the work permit holder may undertake additional
work without further permission provided that the work:
- is outside of their normal working hours;
- is no more than 20 hours per week;
- is in the same profession and at the same professional level
for which the holders work permit visa was issued; and
- is not employed by a recruitment agency, employment agency or
similar business, which provides personnel to a client.
- A work permit holder is also not allowed to enter
self-employment, establish a business or join another business
as a director or partner.
Do I need a job before I can apply for a work permit?
Yes, a job offer is required before you can apply for a work
permit. Please note that it is the UK company that is offering the
position that must apply for the work permit, not the individual
being employed.
Who can apply for a work permit?
Applications for work permits can only be made by UK-based
employers on behalf of the person they wish to employ. An individual
cannot apply for a work permit on their own behalf.
Nationals of which countries require a work permit?
All non-EEA nationals who do not already have a valid visa to work
will require a work permit. If you are from outside the EU you will
need a work permit.
Can I travel abroad while on a work permit?
Yes, you are free to travel abroad whilst your work permit is valid
for normal annual leave and company related travel.
How long are work permits granted for?
A work permit can be granted for any period between one day and
five years.
If I am on another visa, can I still get a work permit?
Yes, you may be eligible for a work permit visa depending on your
current UK visa status and your skills and qualifications.
Must the entry clearance part of the work permit application be
applied for in my home country?
Yes, entry clearance for a work permit must be applied for in your
country of birth or in a country where you have legal residence.
If I am already in the UK on a work permit, will I need to leave
the country if I want to change employer?
No, you can remain in the UK while the new work permit application
is considered.
